By accessing or using PayLink's services, website, or APIs, you agree to be bound by these Terms of Use and all applicable laws and regulations. If you do not agree with any part of these terms, you may not use our services.
Eligibility
You must be at least 18 years old and capable of forming a binding contract to use our services. If you are using PayLink on behalf of an organization, you represent that you have the authority to bind that organization to these terms.
Account Registration
To access certain features, you must register for an account. You agree to provide accurate, current, and complete information during registration and to update such information to keep it accurate and complete.
Services Description
Payment Processing
PayLink provides AI-powered payment infrastructure that enables integration with various payment providers including M-Pesa, Airtel Money, Equity Bank, and KCB. Our services facilitate payment processing, not the actual movement of funds.
API Access
We provide APIs that allow developers to integrate payment functionality into their applications. Access to our APIs is subject to these terms, our API documentation, and any applicable rate limits.
Service Availability
While we strive for high availability, we do not guarantee uninterrupted access to our services. We may modify, suspend, or discontinue any part of our services at any time with reasonable notice when possible.
User Obligations
Lawful Use
You agree to use our services only for lawful purposes and in accordance with these terms. You must not use our services in any way that violates applicable local, national, or international laws or regulations.
Account Security
You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must notify us immediately of any unauthorized access or security breach.

Fees & Payment
Service Fees
Our services may be subject to fees as outlined in our pricing documentation. You agree to pay all applicable fees associated with your use of our services.
Fee Changes
We may modify our fees at any time with 30 days' notice. Continued use of our services after a fee change constitutes acceptance of the new fees.
Billing
Fees are billed according to your pricing plan. You authorize us to charge your designated payment method for all applicable fees. Failure to pay may result in service suspension.
Refunds

PayLink and its licensors own all rights, title, and interest in our services, including all intellectual property rights. Our name, logo, and all related marks are trademarks of PayLink.

We grant you a limited, non-exclusive, non-transferable license to use our services in accordance with these terms. This license does not include the right to modify, distribute, or create derivative works.
Your Content
You retain ownership of any content you submit through our services. By submitting content, you grant us a license to use it as necessary to provide our services.
Disclaimers & Limitations
As-Is Basis
Our services are provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.
Third-Party Services
Our services integrate with third-party payment providers. We are not responsible for the actions, content, or policies of these third parties. Your use of third-party services is at your own risk.
Limitation of Liability
To the maximum extent permitted by law, PayLink shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues.
Indemnification
Your Indemnification
You agree to indemnify, defend, and hold harmless PayLink and its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from your use of our services or violation of these terms.
Notice of Claims
We will notify you of any claim subject to indemnification and provide reasonable cooperation in the defense of such claim. You may not settle any claim without our prior written consent.
Termination
By You
You may terminate your account at any time by following the account closure process in your dashboard or by contacting our support team.
By Us
We may suspend or terminate your access to our services at any time for any reason, including violation of these terms, with or without notice depending on the severity of the violation.
Effect of Termination
Upon termination, your right to use our services will immediately cease. Provisions of these terms that by their nature should survive termination will survive, including intellectual property, disclaimers, and limitations of liability.
Dispute Resolution
Governing Law
These terms shall be governed by and construed in accordance with the laws of the Republic of Kenya, without regard to its conflict of law provisions.
Informal Resolution
Before filing any formal dispute, you agree to first contact us and attempt to resolve the dispute informally. Most disputes can be resolved quickly and amicably through direct communication.
Arbitration
Any dispute that cannot be resolved informally shall be resolved through binding arbitration in accordance with the rules of the Nairobi Centre for International Arbitration (NCIA).
